We operate as a service provider on a contingency basis, meaning our fee is earned only upon successful recovery of funds. Our services are administrative in nature and do not include legal representation or attorney services.
To be eligible for our services, you must be 18 years or older and have legal standing as the original homeowner or rightful heir of a property that went through foreclosure. You must provide accurate information about the property and foreclosure. We reserve the right to decline representation of any individual or case where we determine eligibility criteria are not met, where the foreclosure occurred outside applicable claim deadlines, or where legitimate ownership cannot be established. Cases involving fraud, disputes over ownership, or other legal complications may be rejected.
We operate on a contingency fee basis. You pay no fees unless we successfully recover surplus funds for you. Upon recovery, our fee is a percentage of the recovered amount as agreed to in writing in your service agreement. This fee covers all of our work including research, documentation, filing, and claim management. You are not responsible for additional costs such as state filing fees or administrative charges unless specifically agreed upon in writing. Payment is due from recovered funds before disbursement to you.
You are responsible for providing accurate, complete, and truthful information about yourself, your property, and your foreclosure situation. You must cooperate with our team, respond to requests for additional information, and provide supporting documentation when requested. You agree to inform us of any changes in your contact information, financial status, or case circumstances. Failure to cooperate or providing false information may result in termination of services and potential legal consequences.
All content on our website, including text, graphics, logos, images, and software, is the property of US Surplus Recovery Inc or its content suppliers. You may not reproduce, modify, distribute, or transmit any content from our website without written permission. You retain all rights to information you provide to us regarding your case, but grant us a license to use that information solely for purposes of providing our services.
To the maximum extent permitted by law, US Surplus Recovery Inc shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. This includes damages for loss of income, lost profits, lost data, business interruption, or other economic loss. Any action or proceeding arising under these terms shall be subject to the federal and state courts of the jurisdiction where we are located. You agree to submit to the jurisdiction of these courts and waive any objection based on inconvenient forum.
Before pursuing legal action, you agree to attempt to resolve disputes through informal negotiation. If negotiation does not resolve the matter within 30 days, either party may pursue other remedies available under law. Any binding arbitration or mediation clauses from your service agreement take precedence over general litigation.
Either you or US Surplus Recovery Inc may terminate the service agreement at any time by providing written notice. Upon termination, we will transfer all case materials and documentation to you or to a representative of your choosing. If the service is terminated before case completion, you may be responsible for certain out-of-pocket costs incurred on your behalf. Contingency fee obligations remain in effect if we successfully recover funds after the stated termination date from work performed prior to termination.
While we have successfully recovered funds in many cases, we cannot guarantee results in any specific case. Recovery depends on numerous factors beyond our control, including state regulations, available surplus amounts, documentation availability, and administrative processing times. Past results do not guarantee future outcomes. Your agreement with us is for our services, not for a guaranteed result.
We reserve the right to modify, suspend, or discontinue our website or services at any time without notice or liability. We may add or remove features, change functionality, or alter access to services. We will make reasonable efforts to notify clients of significant changes affecting active cases.

These Terms and Conditions, together with your individual service agreement, constitute the entire agreement between you and US Surplus Recovery Inc regarding your use of our website and our services. These terms supersede any prior agreements or understandings. No waiver of any provision is effective unless in writing and signed by both parties.
If any provision of these terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if that is not possible, shall be severed. The remaining provisions shall continue in full force and effect.
